Terms of Service

These terms apply to delivery requests made through this website and to the deliveries we make as a result. By sending a request you agree to them. If anything here is unclear, call or text us at (254) 863-8181 before you order.

1. A request is not yet an order

The form sends us a request. The price it shows is an estimate calculated from the materials, quantity and driving distance you entered. We confirm the final price, quantity, pit and delivery time with you by phone or text, and the order exists only once you have confirmed it with us and payment has been arranged. We may decline a request, for example where the address is outside our delivery range or a material is out of stock.

2. Pricing

Aggregate is sold by the ton and mulch by the cubic yard. Loads are limited to about 7 tons of aggregate or 18 yards of mulch per truck, and larger quantities are delivered as several loads, each carrying its own delivery charge. Texas sales tax of 8.25% is added. Material prices come from the supplying pit and can change without notice until we confirm your order. Quantities are rounded up to the next whole unit, and the tonnage on the pit's scale ticket is what you are charged for.

3. Payment

Payment is due before delivery unless we agree otherwise when confirming the order. We do not take payment through this website.

4. Delivery

  • We deliver Monday to Friday. The delivery window is confirmed with you; times are estimates and can be affected by weather, road conditions and pit hours.
  • You must provide a delivery spot that a loaded dump truck can reach and turn in safely, and clear drop-off instructions if you will not be present. If the driver cannot deliver because the site is inaccessible, unsafe or nobody can direct the drop, the load may be returned and a trip charge applies.
  • Material is dumped where you direct. Heavy trucks can mark driveways, sidewalks, lawns and underground services such as sprinklers or septic lines; we are not liable for that damage when we have followed your placement instructions.
  • Once material is dumped at your site it cannot be taken back. Check the material and quantity with the driver before the truck leaves.

5. Cancelling or changing an order

You can cancel or change a confirmed order at no charge up to the point the truck is loaded at the pit. After loading, the material and delivery charges apply.

6. Natural materials

Rock, sand, soil and mulch are natural products. Colour, size and moisture vary from load to load and from the photographs on this site. Quantities calculated by the project calculator are estimates only.

7. Liability

To the fullest extent permitted by Texas law, our total liability for an order will not exceed the amount you paid for it, and we are not liable for indirect or consequential loss such as project delays. Nothing in these terms limits any liability that cannot be limited under Texas law.

8. Using this website

The website is provided as is for pricing and requesting deliveries. Do not use the request form to send spam or anything unlawful, and do not attempt to interfere with the site. Links to other sites are outside our control.

The address suggestions and the delivery quote use Google Maps. By using them you also agree to the Google Maps/Google Earth Additional Terms of Service (opens in a new tab) and Google's privacy policy.

9. Privacy

How we handle the information in your request, including calls and texts about your order, is described in our Privacy Policy.

10. Governing law and changes

These terms are governed by the laws of the State of Texas, and any dispute will be brought in the courts of McLennan County, Texas. We may update these terms; the date at the top shows the current version.
